CFTC Moves Toward New Federal Framework for US Crypto Markets

The US Commodity Futures Trading Commission (CFTC) has introduced a proposed regulatory framework that could bring certain cryptocurrency trading activities under greater federal oversight. The proposal specifically targets crypto exchanges that offer leveraged or margined digital-asset trading to retail customers.

The development comes at a time when broader efforts in Congress to establish comprehensive cryptocurrency legislation have stalled. The proposed CFTC framework could provide exchanges with an alternative to navigating the fragmented regulatory requirements currently imposed across individual US states.

Proposed Federal Regulatory Path for Crypto Exchanges

Under the proposed approach, eligible US-based crypto exchanges could choose to operate under a federal regulatory framework instead of relying primarily on state-level money-transmitter licensing. The CFTC intends to use its existing statutory authority over margined and leveraged spot commodities to establish this framework.

The agency has long sought expanded authority over spot cryptocurrency markets, many of which continue to operate within an uncertain regulatory environment. However, broader federal authority over spot crypto trading would ultimately require Congress to provide additional legislative authority.

CFTC Chairman Michael S. Selig said the agency's objective is to provide greater clarity and stronger consumer protections while incorporating crypto transactions into a consistent national regulatory structure.

Selig also indicated that the proposed rulemaking is aligned with the Commodity Exchange Act (CEA) and the administration's direction to develop a federal framework for crypto market structure using the CFTC's existing powers. The regulator also intends to establish preventive safeguards aimed at reducing the likelihood of fraudulent activities similar to the FTX collapse.

New Category for Regulated Crypto Trading Platforms

A central element of the proposal is the creation of a new classification known as “crypto asset markets.” The category would cover platforms that provide leveraged or margined crypto trading services to retail participants.

Exchanges operating under this framework would need to comply with requirements designed to strengthen market integrity. These measures could include protections against manipulation and mandatory disclosures related to proof of reserves.

The CFTC is also considering a requirement for registered futures commission merchants to serve as intermediaries for transactions conducted by customers through these newly regulated platforms.

Although the proposal does not establish a specific maximum leverage ratio, exchanges would need approval from CFTC staff before introducing leveraged products. This could give the regulator greater oversight of how such products are introduced and offered to retail traders.

Crypto Regulation After the Clarity Act Stalls

The proposal arrives after the US Congress failed to make significant progress on the Clarity Act, legislation designed to establish a more defined regulatory structure for the country's approximately $2 trillion cryptocurrency market.

The proposed legislation would have offered greater certainty to crypto businesses while giving the CFTC a more explicit role in supervising parts of the spot digital-asset market.

With lawmakers unable to reach an agreement, federal regulators such as the CFTC and Securities and Exchange Commission (SEC) have increasingly taken a central role in shaping the country's cryptocurrency regulatory environment.

However, the approach also carries uncertainty. Analysts note that regulatory measures introduced without comprehensive congressional legislation could face legal challenges or be affected by future political changes. As a result, businesses operating in the US crypto market may continue to face uncertainty until a broader legislative framework is established.

Crypto Market Update

Bitcoin was trading between approximately $85,000 and $86,000 on October 6, after briefly moving close to the $87,000 level. Market participants continued to monitor elevated US Treasury yields alongside expectations that the Federal Reserve could take a less restrictive approach to monetary policy.

Ethereum was trading around $2,700, while XRP remained near $1.50 and Solana around $120.

Bitcoin has continued to consolidate around the $85,500–$86,000 area following another attempt to break above $87,000. According to Avinash Shekhar, Co-Founder and CEO of Pi42, the broader market structure remains constructive, although higher US bond yields continue to create short-term pressure. Maintaining support above $85,000 could be important for Bitcoin's near-term momentum.
